Microsoft plans to appeal; the court also said the software maker must pay $240 million in patent-violation damages

A Judge on Tuesday ordered Microsoft (NSDQ: MSFT) to stop selling its popular Word document creation application in the United States in 60 days, after finding that the software contains technology that violates a patent held by a third party.

Microsoft Office, which includes Word, accounted for more than $3 billion in worldwide sales in Microsoft's most recent fiscal year and is used by literally millions of businesses and consumers for everyday tasks like word processing and making spreadsheets and presentations.

The judge said the ruling applies to Word 2003 and Word 2007.

Investors shrugged off the news—perhaps in anticipation of a higher court overturning the ruling, which arose from the plaintiff-friendly Eastern Texas federal jurisdiction. Microsoft shares were up 1.6% to $23.50 in early trading Wednesday.

Judge Leonard Davis, of U.S. District Court for Eastern Texas, said Microsoft "unlawfully infringed" on a patent that describes how programs go about "manipulating a document's content and architecture separately." The patent, No. 5,787,449, is held by Toronto-based i4i, Inc. i4i develops "collaborative content solutions," according to its Web site. i4i originally sued Microsoft for patent infringement in 2007.

"We are disappointed by the court's ruling," Microsoft spokesman Kevin Kutz said in an e-mail. "We believe the evidence clearly demonstrated that we do not infringe and that the i4i patent is invalid. We will appeal the verdict."

Davis on Tuesday ordered Microsoft to pay $240 million in damages to i4i, plus court costs and interest. More significantly, he enjoined Microsoft from continuing to sell Microsoft Word, in its current form, in the U.S.

Specifically, Davis said Microsoft can't sell versions of Word that can open documents saved in the .XML, .DOCX, or .DOCM formats that contain custom XML. Those formats were at the heart of the patent dispute. .DOCX is the default format for the most current version of Word, which is included in Microsoft Office 2007. Custom XML is used by businesses to link their corporate data to Word documents.

"Microsoft Corporation is hereby permanently enjoined" from selling Word 2003 and Word 2007 in the U.S. Davis, wrote in his order.

Davis also prohibited Microsoft from providing technical support for infringing products sold after the injunction takes effect, or from "testing, demonstrating, or marketing the ability of the infringing and future Word products to open an XML file containing custom XML."

Davis said the injunction does not apply to versions of Word that open an XML file as plain text or which apply a transform that removes all custom XML elements—possibly paving the way for Microsoft to issue a patch that rectifies the problem.

Love It or Leave It?

Abstinence-only advocates have finally come to the realization that sex sells, so they've decided to make their message more sexy. The Candie's Foundation, a group on a mission to educate America's youth about the devastating consequences of teenage pregnancy, teamed up with Seventeen magazine to come up with a new slogan for t-shirts that promote abstinence. The winning slogan — "I'm sexy enough to keep you waiting" — has been printed on a tight-fitting tank top and put on sale for $15. Part of me feels like this shirt is counterproductive because it very publicly sexualizes the girl wearing it, but then again it might make teens more comfortable with the idea of holding off on sex.

What to Download: New Music Today
Tuesdays are big in entertainmentville: not only do all the new DVD releases hit Netflix, but new music also pours into stores. So I take a spin through each week's music releases and pick out some albums and tracks worthy of a download.

So hot right now: We all need pop music to lighten up our iPods every now and then, and that's what Cobra Starship is here to do. With song titles like "Pete Wentz Is the Only Reason We're Famous," it's clear that these guys aren't taking themselves — or anything — too seriously. They may not be the next big thing as far as muscianship goes, but their Summer anthem, "Good Girls Go Bad," is pretty damn catchy. Plus, it features Gossip Girl's Leighton Meester, giving us a taste of what her upcoming album may sound like.

From one mess to another: Erika Jayne makes her album debut with Pretty Mess, but her songs have proved chart-friendly on the Billboard dance charts. While most of the tracks are highly danceable (see: "Everybody Wants Some") Jayne slows it down just a bit with the album's title track and gets a little sentimental on us with "Without You." Jayne has been compared to Madonna, though I'm getting more of a Kylie Minogue vibe. Her electronic dance album just might be perfect for the club scene or a late-night party in your living room.

That country twang: Country star George Strait is still going strong with the release of his 26th album. Twang features top country hit "Living for the Night," which Strait co-wrote with his son, Bubba. My favorite is probably the spunky "Same Kind of Crazy" because the lyric "she's the same kind of crazy as me" makes me smile. Strait released his first album 28 years ago, so check this out if you're into the tried and true of the music industry.

Here's how you can use them to work for you:

1. BE THE CENTER OF ATTENTION
Want to be the one who gets noticed? Stand in the center of the room. According to Dr. Albert Mehrabian, the author of several books and nationally-known expert in the field of spacial psychology, where you are in a room (and what you're doing) has a lot to do with your ability to attract the opposite sex.

Where should you be for the highest impact and the greatest number of interested cuties? Smack-dab in the center of the room, standing up and moving around a bit. (But don't pace a track on the carpet for goodness sake...) If you're in a bar or nightclub, the best place to be is at one of the corners on the bar. Not only will you meet more people, but, according to Mehrabian, bartenters tend to gravitate toward the corners as well.

Interesting conversation AND a full drink? You'll feel like you've died and gone to dating heaven. The worst place to be seen? Hanging out near the wall or sitting at a table. That hot stranger approaching your table and asking "may I join you" only happens in the movies.

2. THE COLOR LURE
What color can you wear to compel the opposite sex to approach you?

According to Color Consultant Leatrice Eiseman, Director of the Pantone Color Institute and author of Colors For Your Every Mood, women are attracted to men wearing the color blue. And why wouldn't we be? According to Eiseman, guys who frequently wear blue are "stable, faithful, constant and always there." The blue guy is a fantastic candidate for a long-term relationship -- someone who's dependable, momogomous and can match his own clothes.

And what about the ladies? Eiseman says women should wear a pink- peach to make themselves most approachable. The color is "very flattering to most skin tones, it gives you healthy glow," and according to Eiseman, projects "a little vulnerability which brings out something protective in men."

Want to wear a color that weeds out guys who can't handle strong women? Try a deep red, burgundy or plum. Men who aren't attracted to strong women will steer clear.

Of all the colors, red is the most sensual. But, wear red with caution. "Red is the color of sex and power," says Eiseman. Red adds an element of excitement and attracts two types of men - men interested in sex, and men attracted to powerful women. Sure, you'll probably have to fend off a lot of freaks, but you could also end up attracting a guy that isn't threatened by the fact that you make a bigger salary.

Concerned your wardrobe is driving people away? Stay away from what Eiseman calls "squished caterpillar yellow-green" which is said to repel both sexes equally.

3. BODY TALK THAT REELS 'EM IN
How do you use body language to attract the opposite sex?

If you're a woman, the key is to make yourself approachable. According to nationally-respected body language expert and professional speaker, Patti Wood, you want to make yourself a "safe" (read approachable) target. How do you accomplish that? Don't take up a lot of space (which is a sign of power and superiority.) Wood says, "we are strong women, but remember, we're trying to get a man to come over and talk to us." She explains, "you have to show you have room for someone else in your life."

In addition, Wood says "to be very approachable women should stand with their feet no farther than 6 inches apart with toes pointed slightly inward. " Other key moves, the nod and the head tilt - signal you're listening to what the other person has to say.

For men, appearing more dominant effectively draws the attraction of women. To attract women, stand with your feet 6-10 inches apart, and toes pointing outward. Feel free to take up some space. For men who are victims of the "nice guy" badge, or who appear to be too submissive to attract women, try taking your Y chromosome out for a spin. According to Mehrabian, men should "try wearing bulkier or more conservative hairstyles or clothing," hold your head up, and speed up your speech and gestures to be more assertive.

Body language tips for both sexes: Don't fold your arms and don't chew on gum, ice or your fingernails. According to Wood, the chewing indicates anxiety or frustration, neither of which are very attractive emotions.

4. THE POWER OF A SMILE
Psychology and body language experts agree that one of the most important things you can do to make yourself more attractive (and approachable) is to smile. Not a great big plastic game-show smile, just your normal "I'm having a great time and I'm happy to be here" face will do the trick. According to Wood, "the smile is the international signal of friendliness."

5. TEMPTING WITH SCENT
Studies show that men associate the scents of cinnamon and vanilla with love. To make the scents work for you, try baking some ready-made cinnamon rolls about an hour before your date arrives, or, wear a cinnamon-vanilla scented perfume (there's a fabulous vanilla perfume called "Dulce Vanilla " ). Aromatherapy experts have long-believed cinnamon to be an aphrodisiac.

According to Laura Davimes, aromatherapy and herb expert , and owner of Herban Avenues, "certain aromatic plants exude oils similar to our own sexual secretions or pheromones. Wearing cinnamon/vanilla blends increases the presence of pheromone-like substances and dramatically increases attraction."

The scent of a woman? Women, according to a recent study, are attracted to a black licorice scent. So, be sure to pick up licorice or Good 'n Plenty at the theater snack bar. And, if you're at a club and happen to spill a little Jaggermeister on your shirt, don't worry about the stain, just consider it your lucky night.

Katie Price allegedly "ruined" her gay best friend's marriage ceremony by launching into a foul-mouth tirade.

The glamour model - who is currently embroiled in a bitter divorce with estranged husband Peter Andre - appalled guests as make-up artist Gary Cockerill and Phil Taylor renewed their wedding vows by drunkenly calling them "*****" after she refused to sing live on a karaoke machine.

One onlooker told Britain's The Sun newspaper: "She said she wouldn't sing live because there were too many ***** there who would enjoy hearing her sing off-key. She said we were all *****. Then she said Peter was a f**king a**ehole.

"People were walking out. She ruined everything."

Katie, also known as Jordan, had been due to perform during the happy couple's first dance. Instead Gary and Phil took to the dancefloor while she mimed to Whitney Houston's 'I Have Nothing'.

The 31-year-old star performed the song twice more before she was led away from the stage.

Onlookers at the bash at London's Syon House on Saturday (08.08.09) also claim her children - Harvey, seven, Junior, four, and two-year-old Princess Tiaamii - overheard her foul-mouthed tirade.

She was accompanied to the nuptials by new boyfriend Alex Reid.

It has been claimed she is desperate to have a baby with the cage fighter as she believes getting pregnant will help her get over her split from Peter, and also bring her and Alex - who she began dating last month - closer as a couple.

A friend said: "She knows there is no going back to Peter, so she is determined to move on and put the past behind her. Kate has really opened her heart to Alex. She thinks it would be good to start trying for a baby with him as soon as her divorced is finalised."

The couple are said to be smitten with each other and his mother claims he has fallen in love with the 31-year-old beauty.

Carol said: "Alex is in love with Katie. They're young and they're happy. They're not hurting anyone.

"Being with Katie has put a big smile on his face."

Lindsay Lohan puts whipped cream on her morning cereal.

The 'Mean Girls' actress is such a fan of the fattening dairy treat she can't bare to have a meal without it, and even slathers it over her breakfast.

A source said: "Lohan shared this personal food fact - she loves whipped cream so much, she even puts it on her oatmeal in the morning."

The 23-year-old actress let her guilty food secret slip while out celebrating her on/off girlfriend Samantha Ronson's 32nd birthday on Friday (07.08.09).

Samantha was due to DJ at Chicago's Hotel Sax's Crimson Lounge, and was amazed when Lindsay and her younger sister Ali Lohan flew to the US city to surprise her on her special day.

The trio and a group of friends ate dinner at eatery Hub 51, where they munched chicken and steak tacos followed by carrot cake.

Lindsay - who has completed three stints in rehab - and Samantha frequently went outside to smoke cigarettes, prompting an onlooker to chastise her.

Lindsay replied: "This is far from the worst thing I've ever done to my body!"

The group then went to watch Samantha perform, after which they moved on to nightspot Angels and Kings.

Body Language
Being able to successfully judge whether or not your date is attracted to you and enjoying your company can be tricky. However, there are clues in the body language which you can use to find out whether your date will be hoping for a goodnight kiss at the end of the night. If your date displays a cluster of the signs below, it is likely that they're more than just a little bit interested in you...

Positive positioning
As strange as it may sound, your date's feet will give a lot away, more specifically, the direction in which they're pointing. So if they are aimed towards you, as opposed to the exit, you can safely assume that his/her attention is focused on you.

"Open" gestures
Unfolded arms will typically indicate that your date is comfortable in your company and willing to open up to you. Similarly, upturned palms during conversation will show that your date is genuine and not closed off. However, bear in mind that your date may cross their arms, or clench their fists if they're feeling cold!

Leaning
If your date leans in towards you it's a positive sign. You shouldn't be afraid to "mirror" this action by leaning towards them to meet them halfway. You can also subtly mirror other positive bodily cues, like smiling and head tilting.

Smiling and laughing
This body language is pretty obvious, and provides a clear indication that your date is enjoying your company, particularly if he/she is in stitches at your repertoire of terrible jokes! Smiling can be very powerful because a smile is never straightforward. If your date is attracted to you, their smiling is likely to become coy and playful rather than merely friendly and welcoming.

Head tilting
Head tilting is a great way of telling whether or not you're captured your date's interest. If your date tilts their head to the side it's a positive indicator of attentiveness. However, if your date's head is pointing downwards or turning to allow them to look around the room, it's likely that your conversation is boring!

Raised shoulders
Raised shoulders typically accompany the leaning posture, and exhibit interest and attraction. In everyday interactions, women commonly raise their shoulders as a reaction to something which is cute or charming. So guys, if she does it when you're around, it can only be a good thing.

Posture
When flirting, men and women will naturally adopt a posture which emphasises their masculinity or femininity. Men tend to stand tall with their chest forward, while women subconsciously adopt a pose which shows off their feminine features such as their hips or chest.

Playing
Women will often play with something, such as their jewellery, their hair or their wine glass when they're attracted to a man. However, guys, be careful not to confuse this with fidgeting which is a sign of boredom! Positive playing will be slow and hypnotic, whereas fidgeting will be fretful and annoying.

Excuse touching
During your date, if the person you are with is enjoying your company, he/she will casually touch you to test the water. For example, he/she may touch your wrist during conversation, or touch your hand "accidentally" when you both reach for the menu, and so on. You might like to try this "excuse" touching yourself if you're attracted to someone but feel unsure of how they feel about you. If they don't pull away from your touch, and initiate similar "excuse" touching, it's looking good!

The gaze
When we see a possible dating opportunity, we tend to "eye-up" the person concerned. This involves casting our eyes over the other person's eyes, then looking at their lips, then down towards their body, and back up to meet their gaze. This is likely to be a rapid process, but if you catch your date checking you out on more than one occasion, it's more than likely they're enjoying the view!

Prolonged eye contact
If your date is making frequent and prolonged eye contact, it is a positive sign of their attraction to you. Your date's pupils are also likely to dilate if they're feeling the love. Watch out for whether your date uses the flirtatious "come to bed" look where the head is tilted downwards and the eyes are looking up towards you, as another positive indication of attraction.

Lip gazing/Biting
You may notice your date looking at your lips on several occasions, particularly if they're hoping for a kiss! Women will sometimes subconsciously bite their lip while flirting with a man as a sign of attraction.

Breathing patterns
When your date is really feeling the sparks fly as the attraction intensifies, their breathing will become slower and heavier. This happens during the lust phase, and is more likely to occur further into the relationship as opposed to on the first date, unless the initial sexual chemistry is explosive!

Ready to kiss
Knowing whether or not someone would like to be kissed is often tricky. If you've noticed your date displaying a fair amount of the bodily cues above, particularly the excuse touching behaviour, they could well be hoping for a kiss. So, if your date is standing close to you (closer than a friend/family member would usually stand), gazing into your eyes and looking at your lips a lot, has their lips are parted, and seems to be lingering a while, it's likely that they're after your killer kiss.

Rani Mukherjee is all set to be back with a bang. Her sizzling hot curves is making her fans and the audience go ga-ga over her up coming flick Dil Bole Hadippa. The actress has worked pretty hard for it, as she had to don a bikini.

Our sources reveal that, “Rani is donning a similar look of that of Kareena in the song Chaliya, in the remix version of the title track of this film, where you can see her wearing hot pants and a bikini top.”

“She has been gyming and has been following a proper diet to fit herself in those hot pants. Though her look in the film is very different from what we see in the song.

Shahid and Rani are complementing each other, when it comes to the moves, as they have danced pretty well and their jodi is looking super fabulous in the film too, ” adds the source.

EVELYN MCDONNELL: How does it feel to step outside the Spice Girls with your solo debut Northern Star [Virgin]?
MELANIE C: It's all my dreams come true. It's something that I've wanted to do for a long time. It's quite a personal album. All the songs reflect on what we've been through over the last few years. Also, I've explored a wider range of musical directions. I take more of the rock angle on a lot of songs, and there's some lovely acoustic numbers and there's still pop.

EM: Have you always been a rock fan?
MC: Yeah. I was brought up with a lot of rock music because my mom had always been in bands. I find it very emotive.

EM: I heard that MTV is not playing the first video, "Goin' Down."
MC: There was a little bit of controversy because there are a couple of words in there that they feel are a bit strong for a younger audience. But they love the video, and I think they'll play it after a certain time or maybe bleep out a couple of words.

EM: What are the words?
MC: It's a song about when I was a little bitter about a relationship that had ended. I say: "From this little hitch, I've become a superbitch," and then, "Well, I'm not a whore, I've just gone hardcore." It's not very Spice, is it?

EM: You do have such young fans, and of course, you're getting older. Has there become more of a gap?
MC: We're always very proud of how young our fans are because when you're that young, you're not corrupt. You just enjoy something because you like it, not because the media is telling you that this is cool. But I think with this album, I'd like to be accepted by an older crowd.

EM: Do you think you'll ever have to change the group's name from girls to something else?
MC: Spice Women? Old bags? Can you imagine us being forty doing "Wannabe"? No, we'll always be girls at heart, no matter how old we are.

EM: Did you grow up in a feminist household?
MC: Not really. It was very equal. I've got a brother and we both had to do the washing up and my stepfather was always Hoovering and stuff, so it wasn't the typical wife in the kitchen and husband goes out and gets the money. We all shared everything and it's like that now. I go home and go, "Mom, I'm really famous." She says, "Yeah, but I don't care. Do the washing up."

EM: How exactly did you come to earn the name Sporty?
MC: That was just a tag which was put on me because of the way I dress. I've always been a bit of a scruff; I've always been into casual clothes. I'm not really one for wearing skirts and getting dressed up very often. All the [other Spice] Girls wear those silly clothes; they look fantastic, but they're so uncomfortable. Whenever we go out, they're all in their heels. Halfway through the night everyone's going, "I'm so jealous. I wish I had your sneakers on." So you see, I got the best name.

EM: One of the things that's really great about the Spice Girls is that you're an example of women bonding and having fun together.
MC: Women are always perceived to be bitching about each other or scratching each other's eyes out, when really there's nothing better than a good girly gang you can turn to when your man dumps you. You always call your friends up and they save they day, don't they?

EM: How much were you in touch with the other girls while you were recording your solo album?
MC: Quite a lot. I have to do my catching up at least once a week, find out all the gossip.

EM: Is it going to be hard to be on stage without them?
MC: No, it'll be great, 'cause I won't have to do dancing. I can just do what I want. I can just sing and jump around. And if I do make a mistake, I've only got myself to blame. It's a relief. Weight off my shoulders.

SYNOPSIS:

Control over the aliens has been contracted out to Multi-National United (MNU), a private company uninterested in the aliens’ welfare – they will receive tremendous profits if they can make the aliens’ awesome weaponry work. So far, they have failed; activation of the weaponry requires alien DNA.

The tension between the aliens and the humans comes to a head when an MNU field operative, Wikus van der Merwe (Sharlto Copley), contracts a mysterious virus that begins changing his DNA. Wikus quickly becomes the most hunted man in the world, as well as the most valuable – he is the key to unlocking the secrets of alien technology. Ostracized and friendless, there is only one place left for him to hide: District 9.

SYNOPSIS:
Disney Channel superstars Vanessa Anne Hudgens ("High School Musical 1 & 2," "High School Musical 3") and Alyson Michalka ("Phil of the Future," pop duo Aly and AJ) join Gaelan Connell ("Chocolat"), Scott Porter ("Speed Racer") and Lisa Kudrow ("Friends") in the music-driven comedy "Bandslam." When gifted singer-songwriter Charlotte Banks (Michalka) asks new kid in town Will Burton (Connell) to manage her fledgling rock band, she appears to have just one goal in mind: go head-to-head against her egotistical musician ex-boyfriend, Ben (Porter), at the biggest event of the year, a battle of the bands.

Against all odds, their band develops a sound all its own with a real shot at success in the contest. Meanwhile, romance brews between Will and Sam (Hudgens), who plays a mean guitar and has a voice to die for. When disaster strikes, it's time for the band to make a choice: Do they admit defeat, or face the music and stand up for what they believe in?
